Do you have the shopkeepers address ?
From MPCTA guy or anywhere?
Shopkeeper won't listen easily, he will always be out of town, at his grandpa's funeral, at his mother's wedding and so on....
Ask Zotac/Aditya why they denying warranty. The exact reason, everywhere the warranty is from date of import.
Something else must be wrong. Maybe he sold you an old used card or something like that.
You should start the procedure for filing the case. Make both the shopkeeper and dealer the party, else both will keep blaming each other if you make only one the party. When both are party, they can fight out in front of judge who should solve your problem.
Stress on refund now, don't go for warranty claim. They can handover you another old card and you will keep running after them.

@topgear i have been following you for i guess 2-3 years now... you do deserve it.
@Giraffe

i have his address now, i will pay him a visit tomorrow as he asked me to do so.

if he remains out of town tomorrow, i will contact him no further and just file the case on monday right away. i have asked many lawyers, theres no need to send notices myself, also i have given enough time to shopkeeper to rectify his fault.

zotac guys dont want to listen to anything, for anything i say they replied/will reply that the product is out of warranty.

i am making parties to all of them, zotac, aditya and the shopkeeper.

and if he resolves the issue i wont take another gtx 470 this time, i will go for some current gen card with the same performance. which one should i go for? 650ti?

demand for either refund or credit note if the seller can rma it for you instead of replacement. Gtx 650 ti offers similar performance but see if you can get the boost edition if you must.

Btw, I'm still a little suspicious about the gpu the seller has, sold you but everything is going to be unfold very soon. God Bless.

If go to court: ask for refund
If settle before: See what all options they give, replacement, credit note etc.

visited the seller today i was in furious mood. the seller took the card and gave me received receipt.

he will contact aditya himself and solve this issue.
he gave me three option

credit note
upgrade to some current gen card and pay the difference in price
or if aditya have any 470(rare case) left with them they will give me that.

so if i go for upgrade path which one should i go for? he was suggesting 760 but the price difference will be much much higher. he will deduct 7.5k from the price.

also what about credit note? it will be applicable on zotac product(any shop) or just from the shopkeeper?

Isn't Credit note and upgrade (with paying the difference) almost same thing?

with a credit note you can just get any gpu from the same shop - manufacturer does not matter.

for upgrade unless there's some left over gtx 470 you are limited to zotac only in which case get gtx 650 ti boost retailing around ~14k.

But most probably zotac will replace your gpu with some upgraded model free of cost

i dont think zotac will just upgrade free of cost, even if they do this is being done via shopkeeper, he will surely ask me to pay for the difference.
if zotac asks me to pay for the upgrade, a decent upgrade (650ti) will cost me 7-8k, i am not willing to spend that much now especially i dont want to pay even a single penny to that cheat.
if i get a credit note, he will cheat in pricing of new GPU.

in all i'm screwed either way.

hmm, then insist on the seller to refund you the full amount and tell him to keep the replaced gpu. If he can sell a gpu once without box then he can do it again - just tell this to him if he somehow try to play some trick.

he wont refund... he already stated that, but i will give another try. right now he asked me for my choice of GPU as the replacement unit, i will ask him to get me a 650ti.

lets see what happens...

damn i was so excited about the consumer case...

Why should u pay for upgraded unit they will give as rma , if their device fails... My friend got 650 by replacing 550, without any problem...
